If that's the case, then why not just add a provision to the room contract that stipulates that you'll forfeit the room if you're found to be re-selling it? If you re-lease an apartment without approval you can be kicked out.. so why couldn't it work with a hotel room, legality wise? I think that kind of thing is frowned upon by the community anyway, so the hotels could get some help there - especially if the room were to go back to con rate once cancelled.
